CONDITIONS OF PARTICIPATION INTERNAL COMPETITION
- Subject of the conditions of participation and organizer
1.1 These conditions of participation govern the terms and conditions for participation in the company’s internal “sweepstakes”. All employees of the NETZSCH Group who have completed the online form in full and answered the competition questions are eligible to participate.
1.2 The organizer of the competition and the person responsible for data protection is NEDGEX GmbH.
1.3 By participating in the competition, the participant accepts these conditions of participation and agrees to the collection, processing and storage of his personal data in accordance with section 9. By participating, the participant also confirms that he/she has had the opportunity to obtain more detailed information on the processing of his/her personal data at https://nedgex.com/dpp/.
2 Participation
2.1 Participation in the competition is voluntary and free of charge and independent of the purchase of any goods or services.
2.2 Entries in the name of another person will not be accepted.
2.3 Multiple participation is not permitted.
2.4 The competition begins on 22.03.2023 and ends on 26.05.2023 (23:59 CET/MET) (hereinafter referred to as “participation period”). Participation before or after this Entry Period is not possible.
- Prizes and notification of prizes
3.1 We will draw three AMAZON Echo Dot (5th Gen, 2022) from among all eligible participants.
3.2 The winner will be determined by 02.06.2023 from all eligible persons at random and in camera. The winner will be notified in writing by e-mail.
3.3 The participant bears sole responsibility for the correctness, completeness and usability of the information provided by him/her. If the e-mail address provided is incorrect or invalid, NEDGEX is not obliged to investigate correct addresses. Any disadvantages resulting from the provision of incorrect contact information will be borne by the participant.
3.4 If we do not receive an e-mail (hello@nedgex.com) from the winner within the specified period, the claim to the prize is forfeited without compensation. In this case, we are entitled to conduct a substitute draw.
3.5 The prize will be handed over to the winner once. With the handing over of the prize to the winner, the risk is transferred to the winner. If the winner does not contact us within 14 (fourteen) days, the prize will be forfeited without compensation. In this case we are entitled to conduct a substitute draw.
3.6 The prize is not transferable, nor can it be exchanged or paid out in cash. In the event of a loss, the prize will not be replaced. Notwithstanding the aforementioned points, there is also no enforceable claim to payment of the prize.
3.7 All internet and transmission costs associated with the competition shall be borne exclusively and in full by the participant.
4. Exclusion
A violation of these terms and conditions entitles us to exclude the respective participant from participation in the competition, to refuse the delivery of the prize or to deny and/or reclaim the prize already awarded and then to conduct a replacement draw.
5. Early termination and changes
5.1 We reserve the right to suspend the competition at any time without prior notice and compliance with deadlines for a temporary period, to terminate in whole or in part prematurely or to change its course, if it is not possible for technical (eg: computer virus, manipulation of or errors in software / hardware) or legal reasons to ensure proper implementation of the competition. Furthermore, NEDGEX expressly reserves the right to update or adjust these terms and conditions at any time if necessary.
5.2 A temporary suspension as well as a partial or complete termination or modification of the competition does not give rise to any claims whatsoever on the part of the participant against NEDGEX.
5.3 If a premature termination results from the behavior of the participant or other third parties, we can demand compensation from them for the damage incurred.
6 Liability
6.1 The following exclusions and limitations of liability apply to any liability of the organizer, without prejudice to other legal provisions:
- All information is provided without guarantee.
- Upon delivery of the prize, NEDGEX is released from all obligations.
iii. We assume no responsibility for any damage, loss, liability, injury or disappointment incurred or suffered by the entrant as a result of participating in the Sweepstakes and/or accepting the prize.
- All internet and transmission costs associated with the Sweepstakes are the sole and entire responsibility of the entrant. NEDGEX shall not be liable for reimbursement of any costs incurred by entrants who participate in the Sweepstakes.
- NEDGEX assumes no liability for technical failure or any other cause beyond its control that may affect participation in the Sweepstakes.
- Furthermore, NEDGEX shall not be liable for any damage to the entrant’s or any third party’s computer, mobile device, etc. related to or resulting from participation in the Sweepstakes.
vii. A guarantee, warranty or liability claim (in particular for a specific condition or value) for the prize obtained as well as the resulting performance is excluded.
7. Place of jurisdiction
7.1 This competition is subject to German law. Legal recourse is excluded.
7.2 Unless otherwise stipulated by law, the place of jurisdiction shall be the registered office of the organizer.
8. salvatory clause
Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. In such a case, the organizer and the participant are obligated to cooperate in the creation of provisions that achieve a result that comes as close as possible to the invalid provision in economic terms. The same applies to loopholes.
9 Data Protection
9.1 By participating in the competition, the participant agrees to the processing of his/her collected data (these are: first and last name, e-mail address) for the purpose of competition processing and drawing by NEDGEX in accordance with the conditions of participation and within the framework of the legal provisions. This includes a notification via the contact details provided.
9.2 All personal data will be processed internally by NEDGEX for the execution of the lottery. The data will be treated confidentially and will not be passed on to third parties.
9.3 The participant may at any time request information about the data stored about his person, about the origin of the data, the recipients and about the purpose of the storage of this data. In addition, the participant has a right to correction, restriction, deletion and rectification of his data in accordance with the statutory provisions.
9.4 If a restriction or deletion of the participant’s personal data requested by the participant results in the participant not being notified of his/her prize or in the prize not being able to be handed over to the participant, the claim to the prize shall lapse without compensation.
9.5 Insofar as the processing is based on the participant’s consent, the participant has the right to revoke the consent with effect for the future. The revocation of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

Insofar as personal terms are only used in gender-specific form in these conditions of participation, they refer to women and men in the same way.
